Terms of service.

These Terms of Service govern your use of the services provided by Hearth Standard. By signing up, paying for the service, or using any part of it, you agree to these Terms. If you are signing up on behalf of a business, you represent that you have authority to bind that business.

1. What Hearth Standard provides

Hearth Standard is a managed operations service. We provide customer communication and operational support on your behalf — including appointment reminders, review requests, missed-call follow-up, customer reactivation messages, lead handling, and reporting.

The service is delivered as done-for-you operations: results are delivered to you through phone, text, and email. There is no dashboard or app to log in to. We configure, run, and maintain the underlying systems on your behalf.

2. The relationship

You are the controller of the personal information about your customers. You determine what information is collected, what messages are sent, and to whom.

We are the processor. We process customer information on your documented instructions and only as needed to deliver the service.

3. Your account

To use Hearth Standard, you must complete the onboarding form, agree to these Terms and the Privacy Policy, and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials.

4. Pricing, billing, and cancellation

4.1 Subscription pricing

Hearth Standard is offered in tiered monthly subscriptions. Pricing in effect at sign-up applies for as long as your subscription remains continuously active. We may change pricing for new subscriptions with at least 30 days' notice.

4.2 Billing

Subscriptions are billed monthly in advance via Stripe. Failed payments may result in suspension after reasonable notice and a grace period.

4.3 Cancellation

You can cancel at any time with 30 days' written notice (email to chance@hearthstandard.com). Service continues until the end of the current paid month. No partial refunds. We will assist with a one-time data export within 30 days of cancellation if requested. After 60 days, all customer data is deleted except SMS consent records retained per the Privacy Policy.

5. Consent obligations

5.1 Authorization

You authorize Hearth Standard to send text messages, emails, and voice communications to your customers on your behalf.

5.2 Customer consent — your responsibility

You represent and warrant that:

  1. Every customer contact has been obtained directly from the customer with consent to receive communications from your business
  2. For promotional or marketing messages, you have obtained prior express written consent as required by the TCPA and applicable state law
  3. You have not provided contact information from third-party lists, scraped sources, or purchased data
  4. You will promptly inform us of any customer who opts out through channels outside the Hearth Standard system
  5. Customers are not on any applicable Do Not Call list, or you have separate consent that overrides DNC status

5.3 Opt-out propagation

Customer opt-outs received through any Hearth Standard channel propagate across all channels for your account, in compliance with FCC rules.

6. Acceptable use

You agree not to use the service to send messages to unconsented recipients, send prohibited content (including SHAFT categories), send deceptive or fraudulent content, violate any applicable law, or reverse engineer or resell the service.

7. AI-assisted content

Some workflows use AI to draft messages and responses. AI-generated content is based on your configuration and inputs and is not always accurate. For content you review and approve before sending, you are responsible for accuracy. For automatic workflows, you approve the configuration and templates in advance.

8. Data ownership

You own the customer information you provide. You grant Hearth Standard a limited license to use, process, and transmit your data solely to provide the service. This license terminates when your account is closed and data deleted. We may use aggregated, anonymized data to improve the service.

9. Confidentiality

Each party agrees to maintain in confidence non-public information designated as confidential. This obligation continues for two years after the relationship ends, except for trade secrets which remain protected indefinitely.

10. Indemnification

You indemnify Hearth Standard against claims arising from your breach of consent representations, inaccurate customer data, content you authorized that violates law, and acceptable use violations. We indemnify you against claims arising from material security breaches caused by our negligence and intellectual property infringement through our service design.

11. Disclaimer of warranties

The service is provided “as is” and “as available.” We disclaim all warranties express or implied. We do not warrant specific business outcomes.

12. Limitation of liability

Neither party is liable for indirect, incidental, special, consequential, or punitive damages. Hearth Standard's total liability is limited to fees paid in the 12 months preceding the claim.

13. Dispute resolution

Any dispute will be brought exclusively in the state or federal courts located in Travis County, Texas. These Terms are governed by the laws of the State of Texas.

14. General provisions

These Terms, together with the Privacy Policy, constitute the entire agreement. We may update these Terms with 30 days' notice. Continued use after changes constitutes acceptance. If any provision is held invalid, the rest remains in effect.
